These Terms of Service ("Terms") govern your use of the Gyde mobile application (the "App") provided by the developer of Gyde ("Gyde", "we", "us"). By installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Acceptance and eligibility
You must be at least 13 years old to use the App. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or legal guardian. By using the App, you represent that you meet these requirements.
2. License to use the App
Subject to your compliance with these Terms, Gyde grants you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your personal, non-commercial use. All rights not expressly granted are reserved.
3. Your account
Certain features require an account. You are responsible for keeping your credentials confidential and for activity that occurs under your account. Notify us at drewb97@gmail.com if you believe your account has been compromised.
4. User conduct
You agree not to:
- Use the App in violation of any law or these Terms.
- Probe, scan, or test the vulnerability of the service, or breach security or authentication measures.
- Interfere with or disrupt the App or its servers, or transmit malware or harmful code.
- Reverse engineer, decompile, or attempt to extract source code, except to the extent that applicable law expressly permits.
- Scrape, harvest, or bulk-extract data from the App or its backend, or use automated means to access the service without our written permission.
- Misrepresent your identity or impersonate another person.
- Use the App to harass, abuse, or harm another person.
Crew names, member names, messages, save notes, reports, and other material you submit are user content. You retain ownership of your user content and grant Gyde a limited license to host, process, display, and moderate it as needed to operate and secure the service.
We may use automated safety checks before publication and may quarantine or remove content, restrict features, or suspend accounts that violate these Terms or our Community Guidelines. Users can report content and block accounts in the App. Moderation appeals may be sent to drewb97@gmail.com.
5. Third-party services, content, and attribution
Gyde relies on a short list of external services to operate. They are named in full, with what each one is used for, on the Attributions page and in Section 4 of the Privacy Policy: Cerebras (the copilot's language model), Tavily (web search and page extraction), Geoapify (geocoding), OpenAI (interest embeddings), Resend (email), Expo (push notifications), Apple and Google (sign-in, and Apple Maps for map display), SURGE (SMS delivery), PostHog (product analytics), Langfuse (copilot tracing), and a server hosting provider.
Place and event details shown in the App are read from the venue's, organizer's, or group's own public web page at the time of the suggestion, and every card links back to that page. That content belongs to its publisher and is subject to that site's own terms; you must comply with them when you reuse anything surfaced through the App. Gyde no longer ingests or redistributes open-data corpora such as Overture Maps, Google Places, Wikidata, OpenStreetMap, or Wikimedia Commons.
Suggestions and answers written by the copilot are generated text. They are a starting point, not an authoritative reference - confirm hours, prices, and ticketing with the venue before you go.
6. SMS terms
If you provide a mobile phone number, Gyde may send the one-time code you request to verify it. After verification, you may separately choose SMS in your profile for alerts about introductions involving other Gyde members. Gyde uses SURGE to deliver those messages and does not send marketing or promotional SMS messages. When you invite someone who is not yet on Gyde, the App prepares a message and link for you to review and send through your own messaging or mail app; Gyde does not send that first invitation through SURGE.
- Opt out: Reply STOP to stop receiving Gyde SMS messages.
- Opt back in: Reply START to resume receiving Gyde SMS messages after opting out.
- Help: Reply HELP for help or email drewb97@gmail.com.
- Message frequency: Message frequency varies based on verification requests and Gyde-member introductions while SMS is selected in your profile.
- Charges: Message and data rates may apply.
- Delivery: Mobile carriers are not liable for delayed or undelivered messages.

7. Informational use only; no guarantee of accuracy
The App's content - including locations, names, descriptions, hours of operation (when shown), photos, and other facts - is provided for informational purposes only and may be incomplete, outdated, or incorrect. Maps and routing involve approximations and may not reflect the real world. Location data from your device is approximate and may be affected by signal conditions, hardware limitations, or operating-system behavior.
Before relying on any information shown in the App, verify it independently. In particular, verify operating hours, access restrictions, accessibility, safety conditions, and travel feasibility through authoritative sources before visiting a place.
8. Safety
Do not use the App in a way that distracts you from your surroundings or compromises your safety or the safety of others. Do not interact with the App while driving, biking, or operating equipment that requires your attention. Follow all signage, laws, and instructions from authorities at any location you visit.
9. Disclaimers
THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL GYDE OR THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US TO USE THE APP IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) USD $50. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless Gyde and the developer from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the App, your violation of these Terms, or your violation of any law or third-party right.
12. Termination
You may stop using the App at any time and may request account deletion as described in our Account Deletion page. We may suspend or terminate your access to the App at any time if we believe you have violated these Terms or to protect the service or other users.
13. App Store terms
If you obtained the App from the Apple App Store, you acknowledge that these Terms are between you and Gyde only, not with Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. You represent that you are not in any country that is subject to a U.S. Government embargo and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
14. Governing law and disputes
These Terms are governed by the laws of the United States and, to the extent applicable, the laws of the state where the developer resides, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. You and the developer agree to attempt in good faith to resolve any dispute through informal contact with drewb97@gmail.com before filing a formal proceeding. If a dispute cannot be resolved informally, it shall be brought in a court of competent jurisdiction in the United States.
15. Changes to the Terms
We may update these Terms from time to time. We will update the "Effective date" above and may notify you of material changes through the App. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
